Who Qualifies for a Chapter 7?
As a result of the new Bankruptcy law effective October 17, 2005, before someone can file for Chapter 7 Bankruptcy, they must first take a pre-filing Debtor Education Course. We arrange for this through our office. This counseling can be done via the internet from the privacy of your own home and usually takes approximately 40 minutes to complete. Once completed, a certificate is issued that must be filed with the Chapter 7 Petition. All Clients must also financially qualify by demonstrating that they do not have the financial ability to pay their obligations. The Clients must submit to our office copies of all payroll stubs or other evidence of their income for the six months prior to filing. This process is commonly referred to as the Chapter 7 "Means Test."
